How Much Does a Prenup Cost?
The costs of a prenup will vary depending on the type of pre-nup you want. A standard pre-nup, out of community of property, excluding profit and loss, should cost around R 3 500 (all inclusive). This will include consultation, notary fees, deeds office, drafting, copies for you etc. There are no hidden fees with Hamel Attorney.
1. How long before the time should you get it done?
As with most things, it's always better to get it done sooner rather than later. One would generally like to consult with your attorney, discuss which type of pre-nup you want, have the attorney draft it, peruse it etc before signing. Once you've decided on what type of agreement suits you best, then it shouldn't take much longer than a few days to a working week for the attorney to draft it and meet with you to sign it.
What is absolutely pertinent though, is you must have entered into the agreement prior to getting married. If you don't sign your pre-nup before thetime, you can't do it after. What must then happen is you must apply to the court for permission to enter into it afterwards as well as let all your creditors know etc. This will end up costing in the region of R 10 000 - R 20 000. Which is far more expensive than just doing it before the time!
2. What Should Be Contained in Your Pre-Nup?
Your attorney should discuss this thoroughly with you. There are 3 different types of matrimonial regimes in South Africa. Selecting the right one for you is of paramount importance. Your matrimonial property regime influences your ability to enter into contracts, can hold you liable for your spouses bad debts (even if incurred prior to marriage) and could even result in you losing half your assets!
